A beneficiary is an applicant who is a member person or organization representing one of the Participating Bands, who applies for a portion of the Available Nation Funds from the Nlaka’pamux Legacy Trust (2013) and whose application has been approved.
Funding will only be provided for projects or events that are anticipated to be completed by the end of the fiscal year, following the year in which the funds are advanced. (For example a project for which funds are advanced in September 2016 must be anticipated to be completed by December 31, 2017)
For projects that are anticipated to take longer than the end of the fiscal year following the year in which funds were advanced, the budget must divided into phases. Each phase must show the planned nature of the expenditure, amount and completion date. Proposals must be submitted in a MS Word file format to the Citxw Nlaka’pamux Assembly (CNA) Manager who will review and forward the Proposals to the Available Nation Funds Steering Committee for review.
Proposals received by the CNA will be forwarded to the Available Nation Funds Steering Committee for review to provide advice and recommendations for funding to the CNA Board of Directors. The Available Nation Funds Steering Committee reviews applications or proposals to ensure they are community based projects that will impact and benefit of CNA Participating Bands, or several communities if it is a pilot project.
The Available Nation Funds Steering Committee may recommend the project for funding through the Nlaka’pamux Legacy Trust (2013) Available Nation Funds, request further information from the applicant, or deny the application or proposal. The Available Nation Funds Steering Committee communicates their recommendations on projects for approval to the CNA Board of Directors.
Applications or proposals that have been recommended for approval by the Available Nation Funds Steering Committee will be forwarded to and reviewed by the CNA Board of Directors for approval. Once the CNA Board of Directors has approved an application for funding, they will prepare a board resolution, signed by a quorum of the Board of Directors, detailing the Fund Uses for which the funds will be used and make reference to each planned project and event and include its detailed budget and timeline. The CNA Manager, on behalf of the CNA Board of Directors, will submit the application and signed resolution, to the Nlaka’pamux Legacy Trust (2013) Trustees for distribution.
The Nlaka’pamux Legacy Trust (2103) Trustees will distribute funds for approved projects, or events that have been submitted by the CNA Board of Directors for Available Nation Funds, directly to the bank account of the beneficiary.
A bank account, separate from the applicant's general operating account, must be opened for the purpose of holding funds received from the Trust. When the application is recommended by the Nation Fund Committee, approved by the CNA Board of Directors and submitted by the Trustees for distribution, money will be deposited to this account.
It is suggested beneficiaries keep copies of invoices, contracts, expense reports and other supporting documents for each payment issued for the project or event. Expenditures for each project or event must be recorded on a separate “Schedule of Receipt and Expenditures of Nlaka’pamux Legacy Trust Funds”.
Beneficiaries are required to have this schedule audited by a certified auditor. The beneficiary is required to provide a copy of the schedule to the Nlaka’pamux Legacy Trust (2013) Trustees. If a cash balance remains at the conclusion of the project or event, it must be returned to the Trust. The Trustees will add these funds to the Available Nation Funds.
Failure to comply with these guidelines may constitute a default under the Trust Indenture. No further distributions may be made to a beneficiary who is in default.
